DMCA Policy
Zeta Earnings Preview ("we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/, we will respond expeditiously to claims of copyright infringement committed using the Zeta Earnings Preview service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.
This policy outlines the procedures for filing copyright infringement notices and counter-notifications with Zeta Earnings Preview.
Filing a DMCA Infringement Notice
If you are a copyright owner or an agent thereof and believe that any content hosted on the Zeta Earnings Preview Site infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material. (Providing URLs in the body of an email is the best way to help us locate content quickly).
- Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid notice, Zeta Earnings Preview will act expeditiously to remove or disable access to the allegedly infringing material and will notify the alleged infringer of the claim.
Filing a DMCA Counter-Notification
If you believe that your content that was removed or disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Designated Copyright Agent:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and e-mail address.
- A statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located, or if your address is outside of the United States, for any judicial district in which Zeta Earnings Preview may be found, and that you will accept service of process from the person who provided the original notification of infringement.
Upon receipt of a valid counter-notification, Zeta Earnings Preview will promptly provide the complaining party with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days. We will replace the removed material and cease disabling access to it within 10 to 14 business days after receipt of the counter-notification, unless our Designated Copyright Agent first receives notice from the complaining party that such party has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system.
